Welcome to MySexySecrets (“MSS”, “Platform”, “we”, “our” or “us”). These Terms of Service (“Terms”) govern your access to and use of the MSS Platform, including all affiliated MSS websites, applications and services. By creating an account or using the Platform, you agree to these Terms.

Welcome to MySexySecrets (“MSS”, “Platform”, “we”, “our” or “us”). These Terms of Service (“Terms”) govern your access to and use of the MSS Platform, including all affiliated MSS websites, applications and services. By creating an account or using the Platform, you agree to these Terms.

2. Definitions

  • Account means a registered user account.
  • Creator means a verified user authorized to upload and monetize Content.
  • User means any person accessing or using the Platform.
  • Content means any photos, videos, audio, live streams, text or other material available through the Platform.
  • Platform means MySexySecrets and any affiliated websites, applications and services operated under the MSS brand.

3. Eligibility

To use MSS you must:

  • Be at least 18 years old (or the age of majority where required by law).
  • Have legal capacity to enter into this agreement.
  • Provide accurate account information.
  • Comply with applicable laws.

MSS may suspend or terminate accounts that do not satisfy these requirements.

4. User Accounts

Users are responsible for:

  • Maintaining accurate account information.
  • Keeping login credentials secure.
  • All activity occurring under their account.

Accounts may not be transferred or shared without MSS approval.

5. Acceptable Use

Users agree not to:

  • Violate applicable laws.
  • Infringe intellectual property rights.
  • Upload fraudulent or misleading information.
  • Attempt unauthorized access to the Platform.
  • Interfere with Platform security or functionality.
  • Circumvent verification or compliance systems.
  • Use automated systems to abuse or overload the Platform.

6. Creator Accounts

Creators must:

  • Complete all required verification.
  • Comply with the MSS Creator Agreement.
  • Upload only Content they are legally authorized to upload.
  • Comply with all applicable Platform policies.

Creator status may be suspended or revoked for non-compliance.

7. Payments

Where applicable:

  • Payments are made according to the MSS payment schedule.
  • Users are responsible for any applicable taxes.
  • MSS may withhold or delay payments where required for fraud prevention, legal compliance or dispute resolution.

8. Intellectual Property

Users retain ownership of their own intellectual property unless otherwise agreed. By uploading Content, Users grant MSS the licence described in the applicable Creator Agreement. The Platform, trademarks, logos, software and branding remain the property of MSS.

9. Copyright

Users must respect intellectual property rights. If MSS receives a valid copyright complaint, MSS may remove or disable access to the relevant Content while the matter is reviewed. Repeated copyright infringement may result in account termination.

10. Privacy

Personal information is processed in accordance with the MSS Privacy Policy. Users are responsible for ensuring that any information they provide is accurate and current.

11. Platform Availability

MSS aims to provide reliable service but does not guarantee uninterrupted availability. The Platform may be updated, modified, suspended or temporarily unavailable due to maintenance, technical issues or legal requirements.

12. Suspension & Termination

MSS may suspend, restrict or terminate access where reasonably necessary, including for:

  • Breach of these Terms.
  • Fraudulent activity.
  • Security concerns.
  • Legal compliance.
  • Repeated policy violations.

Users may close their accounts subject to any outstanding legal or contractual obligations.

13. Limitation of Liability

To the maximum extent permitted by applicable law, MSS shall not be liable for indirect, incidental, special or consequential damages arising from use of the Platform. Nothing in these Terms limits liability that cannot legally be excluded.

14. Indemnification

Users agree to indemnify and hold MSS harmless from claims, damages, losses and reasonable costs arising from their breach of these Terms or violation of applicable law, to the extent permitted by law.

15. Changes to the Terms

MSS may update these Terms periodically. Material changes will be communicated through the Platform or by other reasonable means. Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the jurisdiction specified by MSS, except where mandatory local law applies. Any disputes shall be resolved before the competent courts of the applicable jurisdiction unless otherwise required by law.

18. Entire Agreement
